Agreement to Terms

By accessing or using IoTag services, including our IoTag device, mobile application, and website (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

These Terms constitute a legally binding agreement between you and IoTag regarding your use of our Services. We may update these Terms from time to time, and your continued use of our Services constitutes acceptance of any changes.

Our Services

IoTag provides connected bike protection services, including:

  • IoTag hardware device for bike tracking and monitoring

  • Mobile application for device management and alerts

  • Real-time GPS tracking and theft protection

  • On-demand insurance coverage activation

  • Customer support and technical assistance

Account Security

  • Maintain the security of your account credentials

  • Notify us immediately of any unauthorized access

  • Provide accurate and up-to-date information

  • Use the Services only for lawful purposes

Device Care

  • Install and maintain the IoTag device according to instructions

  • Keep the device firmware updated

  • Report device malfunctions or damage promptly

  • Ensure the device is used only on bikes you own or have authorization to modify

Prohibited Uses

You agree not to:

  • Use the Services to track bikes without proper authorization

  • Attempt to reverse engineer or tamper with IoTag devices

  • Interfere with or disrupt the Services or servers

  • Use the Services for any illegal or unauthorized purpose

  • Share your account credentials with unauthorized parties

User Responsibilities

Service Plans

IoTag offers various service plans with different features and pricing. Plan details, including pricing and included features, are available on our website and in the mobile application.

Billing

  • Subscription fees are billed in advance on a recurring basis

  • Insurance coverage is billed on a usage basis when activated

  • All fees are non-refundable unless otherwise specified

  • We reserve the right to change pricing with 30 days' notice

Cancellation

You may cancel your subscription at any time through the mobile app or by contacting customer support. Cancellation takes effect at the end of the current billing period. You remain responsible for all charges incurred before cancellation.

Subscription and Payments

Insurance Coverage

Insurance coverage is provided through our partner insurance companies and is subject to separate insurance terms and conditions. Key points include:

  • Coverage is activated on-demand and billed per use

  • Claims are subject to investigation and verification

  • Coverage terms are provided by third-party insurers

  • Fraudulent claims may result in service termination and legal action

  • Geographic restrictions may apply based on insurer policies

Privacy and Data Use

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Services, you consent to our collection and use of location data and other information as described in our Privacy Policy. You may adjust your data sharing preferences in the mobile application.

Intellectual Property

The Services and all content, including software, text, images, and trademarks, are owned by IoTag or our licensors and are protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works without our written permission.

Disclaimers and Limitations

Service Availability

We strive to provide reliable Services, but we cannot guarantee uninterrupted availability. Services may be temporarily unavailable due to maintenance, network issues, or other factors beyond our control.

Limitation of Liability

To the maximum extent permitted by law, IoTag shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, including but not limited to damages for bike theft, loss of data, or business interruption.

Warranty Disclaimer

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

Termination

We may suspend or terminate your access to the Services at any time for violations of these Terms, fraudulent activity, or other reasons at our sole discretion.

Upon termination, your right to use the Services ceases immediately. Provisions regarding intellectual property, disclaimers, and limitation of liability shall survive termination.

Governing Law
